So it appears we have a problem with the symptons described in this article...

The value of the DRA (directory replication agent) Pending Replication Synchronizations counter increases but never returns to zero as expected when the pending replication queue has no items in it. This problem may also cause monitoring programs such as Microsoft Operations Manager to issue false alerts about replication failures.
The article says to ring for a hotfix so my collegue does, MS want to charge us £200 for it, now keeping in mind that we spend hundreds of thousands of pounds with Microsoft every year - isn't this a little excessive?
