there is surely license given in this instance, untill kazaa decided to take the license away.

if they wait too long, it's actually possible for them to loose any copyright protection at all, as there is a statute for which you can claim a copyright infringemnt as well.

so, in this regard, alas, we will have to agree

so long as kazaa does not seek to protect their property, and so long as they can be demonstrated to know about the infringement, then it is sure, that they are giving license as long as they have the knowledge of the tresspass and choose not to object
