Computer won't stay in standby or hibernate

Assuming this has something to do with bios so maybe it goes in the hardware section?
I recently just switched from an MSI 890GXM-G65 motherboard to a Gigabyte 990FXA-UD3 motherboard.
I didn't have this problem before with the MSI so I'm assuming its not a windows issue.
The bios are severely "dumbed down" compared to the MSI but what I have it set to now is S3 (other option is S1) with none of the "allow to come out of sleep" functions enabled. The real confusing part is that it comes out of hibernate too. I've never heard of a computer doing that...
I had a problem like this with my Asus A8N-E board a while back but the issue was it being awaken by the network (this gigabyte doesn't have that bios option).
Not sure what I should do here.

EDIT: Problem Solved - It was in the "Realtek Ethernet Diagnostic Utility" I disabled the Wake-On options, specifically the "Wake-On Pattern Match"

So I went through event viewer and found:

I believe that refers to the lan? But I don't have any lan options on the mobo.
